About Attorney Kenneth M. Clayton:

Experience:

Ken Clayton was born and raised in Orlando, Florida.  He has practiced law in Orlando, Florida, primarily in the areas of Real Property, Corporate and Civil law with emphasis in the area of condominium and planned unit development law.  His client representation in this area has included numerous developers, title insurance companies, lenders, purchasers, individual homeowners and numerous community associations.  Ken is involved in creating and developing community properties; reviewing, examining and assisting clients in connection with the purchase, sale and financing of existing and proposed projects; handling sales, negotiations and closings on units.  He has also represented various types of community associations and individual owners regarding a variety of matters before, during and after turnover of control of associations to the homeowners.  Ken has represented both developers and associations during the transition process.  He has further been involved in the representation of a significant number of community associations in their ongoing legal matters, including drafting, interpreting and enforcing the condominium, PUD and subdivision covenants and restrictions.  He has also represented both developers, associations and unit owners in matters regarding the litigation and negotiation of various construction contract matters and land use.  Eminent domain, particularly the unique area dealing with the taking of association properties, is an important part of his practice. 

Education:

Ken graduated from Washington and Lee University in Lexington, Virginia with a Bachelor of Arts in 1970 and from the University of Alabama, School of Law, in Tuscaloosa, Alabama with a Juris Doctorate degree in 1973. 

Experience in Speaking:

Ken has been a featured speaker  on a variety of legal topics.  He has substantial experience speaking before large groups, including  numerous  community  associations  and groups of individual homeowners regarding a variety of association-related issues. Ken participates in the numerous seminars and educational sessions that Clayton & McCulloh sponsors through Central Florida.  He has also spoken at numerous educational programs with different types of audiences, including speaking at Division of Florida Land Sales and Condominium Programs, at the 1984 National Conference for Community Associations Institute in San Francisco, California, and acting as the national coordinator for the National Conference for CAI when same occurred in Orlando, Florida.  Ken has also spoken at an Orange County Bar Association, Real Property Section Seminar, various continuing legal education programs and at numerous programs sponsored by the Mid-Florida Chapter, Community Associations Institute, including the 1995 and 1996 Community Conference cosponsored by Orange County Neighborhood Partnership and Orange County Homeowners Association.  Ken Clayton has also spoken before other groups of professionals and laymen on a variety of related subjects including Florida's Construction Lien Law.

Prior Publications: 

Ken often writes articles published in the Clayton & McCulloh’s quarterly newsletter “Association Developments.”   Ken Clayton has previously served as the Florida State Editor of Significant Court Decisions Involving Real Property, and as the National Editor of Significant Court Decisions Involving Condominiums and Cooperatives for the Significant Decisions Committee of the Real Property, Probate and Trust Law Section of the American Bar Association.  He has also been a Contributing Editor to the National Magazine for Community Association Institute and to the Newsletter that was previously issued by the Mid-Florida Chapter of Community Association Institute.  Ken has also been published in the “Condo Management” magazine. 

Professional Associations

As one of the three original founding members and directors of the Mid-Florida Chapter of Community Associations Institute, Ken has previously served in many capacities with that organization including President.  He is also a member of the Space Coast Condominium Association.  As a member of the Orange County Bar Association, Ken Clayton has been actively involved with the Real Property Committee.  With the Florida Bar, he has been a long standing member of the Condominium and Planned Unit Development Committee of the Real Property, Probate and Trust Law Section.  He has also served on the Development, Operation, and Management of Community Associations, Committee of the Real Property, Probate and Trust Law Section and the Condemnation, Zoning & Land Use Litigation Committee of the Litigation Section of the American Bar Association.  Ken is a member of the Orange County Bar Association, the Florida Bar and the American Bar Association.
